APPENDIX 4 Terms & Conditions of Business
TERMINATION OF STORAGE
Definitions : See General Terms & Conditions of Business
SCOPE : These conditions apply to termination of an existing storage contract requiring the vessel to be removed from the Yard by road or water and initiated by : - An existing owner - A new owner who has obtained valid ownership of a vessel which is in Yard storage - Notice from Dell Quay Marine
1 : Applicable to all transactions : - The loading of a vessel onto or off road transport can only be undertaken with the use of Yard lifting equipment.. Due to Yard Insurers constraints, use of self-load / unload transport with Hiab or similar device is not permitted. - All Crane lifts are subject to a Cranage charge at Yard rates.
2 : Existing Owner
A minimum of 7 days notice is required for termination of storage contract.
For other conditions concerning removal of a vessel from the Yard, see Items 5 & 6.
3 : Owner / Vendor ( Boats sold while in Yard storage)
3.1 : Advise the Yard Office on who ( Vendor or Buyer ) is to be invoiced for the following costs :
3.1.1.- Any unpaid service charges ( Storage, Mooring, Cranage etc. ) up to the date of completion of sale.
3.1.2 - Storage from date of completion of sale, to date of collection from the Yard
3.1.3 - Boat movement and Cranage for loading the boat onto a transporter or launching for collection by water.
3.2 : Buyers details ( for records and invoicing purposes) :
Name……Permanent Address……Contact : Tel / Mob / Fax numbers
3.3 : In addition to the boat, what other separate items are required to be loaded ? ie : Tender, Outboard Motor, etc.
3.4 : Where possible ensure that all non-attached items of equipment are stowed inside the boat, and all hatches are secured.
4 : Buyer ( taking ownership of a boat in Yard storage)
4.1 : Ensure that the details referred to in item 3.2 above are provided.
4.2 : Resolve with Vendor any issues of outstanding payment for Yard services ( See items 3.1 and 5)
4.3 : Buyers who wish to retain storage of a vessel in the Yard, must complete a Yard Services Application form available from the Yard Office.
5 : Payment for Yard Services
Any outstanding payment for Yard services, Storage, Mooring, Cranage etc, must be cleared in full, prior to the vessel leaving the Yard
5.2 : We reserve the right to retain any boat in the Yard until any unpaid service charges are settled in full.
6 : Collection of Boat from Yard
6.1 : Liaise with Yard office on transportation or launching arrangements, including a firm date and time for collection. A minimum of seven days notice ( If launching is required, this will be subject to tidal conditions ) to be given, prior to the proposed collection date, unless agreed otherwise between the parties.
6.2 : Advise Dell Quay Marine and Transporter of any items, in addition to the vessel, that are required to be collected (see item 3.3 above)
6.3 : With change of ownership we require receipt of Written or facsimile confirmation from the vendor / Owner, authorising Dell Quay Marine to release the boat from Yard custody, and the handing over of boat keys if required. .
6.4 : It is the Transporter's responsibility to verify that all items required by their client, are loaded for transportation, and adequately secured.
6.5 : We accept no responsibility for the following :
- Arrival at the Yard of road transport for the collection of a vessel, without prior notification from the Owner.
- Any damage and / or missing items identified before, on or after the arrival of the transporter at its destination.
- Costs resulting from aborted loading for launching as a consequence of any non-compliance with the above conditions.
