APPENDIX 2 Terms & Conditions of Business
YARD STORAGE
Definitions : See General Terms & Conditions of Business
1 : Boat Safety
1.1 : Any craft either shored or standing on its keels with the exception of Tenders, Dinghies, or a craft stored on a trailer, can only be moved by Yard equipment under the control of Yard staff. It is strictly prohibited for owners or others making DIY attempts to move craft.
1.2 : Under no circumstances remove, alter or tamper with in any way, Shores, Wedges, Bracing Battens or Keel Blocks.
1.3 : Owners who do their own antifouling should coat around the Shorings, when the boat is next moved our yard staff will happily touch-up the uncoated patches left after the Shorings have been removed.
1.4 : Whilst a Boat is in Storage, all onboard equipment must be maintained in a secure and safe condition, with appropriate Marine Insurance Cover. We strongly recommend the removal of Sails, Dodgers, Spray Hoods, Cockpit Tents, and Covers that may cause excessive windage to a vessel whilst in storage.
1.5 : Never unfurl or hoist Sails for any reason whilst ashore.
1.6 : We reserve the right to remove any cover which we consider prone to excessive windage.
1.7 : Boats must only be connected to the electricity supply when someone is onboard. We reserve the right to disconnect.
1.8 : Hazardous substances must not be kept onboard.
1.9 : No naked flame appliances to be used onboard whilst in storage.
2 : Boat Delivery / Off- loading to Yard
2.1 : Liaise with Yard office on transportation arrangements, including a firm date and time for delivery. A minimum of seven days notice to be given, prior to the proposed delivery date, unless agreed otherwise between the parties.
2.2 : We reserve the right not to off-load any boat, where no prior arrangement with the Yard Office has been made, or where we consider the boat to be unsuitable for storage in the Yard. Any transportation costs incurred as a result of aborted off-loading, are the sole responsibility of the boat owner.
2.3 : We accept no responsibility for the condition / state of any boat on its arrival at the Yard.
2.4 : In cases where a Boat is delivered on a trailer and left in the Yard without notification or approval of any kind, see Appendix 1 Item 10.1.3 and Appendix 2 Item 4 for the conditions that will apply.
3 : Relocation within Yard
3.1: Boats can be relocated within the Yard at the request of the owner, space permitting. Lifting and movement charges at Yard rates apply.
4 : Residing - Permanent or Continuous Occupancy
4.1: Payment of rent for storage does not afford or imply any rights to create a tenancy or a license of occupancy for the purposes of using a Boat as a permanent residence within the premises.
4.2 : Owners are only permitted to stay onboard overnight when engaged in maintenance or improvement work to their boats, unless we approve otherwise.
4.3 : Owners who wish make overnight stays, do so at their own risk. Our approval is required for stays in excess of 7 consecutive nights.
4.4 : We reserve the right to invoke the Non-Compliance Condition Appendix 1 item 11 where the Owner has resided in excess of 7 consecutive nights without our approval and is unable to provide a verifiable address and Post Code of a permanent residence either owned, rented or leased, and listed in the Electoral Register, and/or where we consider it is the owners intention to take-up permanent or continuous occupancy onboard.
5 : Unauthorised Storage
5.1 : We reserve the right to impound and demobilise any boat, Trailer, vehicle, or any other item parked or deposited anywhere on the premises without our formal authorisation or prior knowledge and approval and where the absent owner fails to provide basic personal details including name, permanent address and contact details.
5.2 : Charges will be incurred at yard storage rates from the date of placement in the Yard until such time as the offending item is removed from the yard at the absent owner's expense.
5.3 : We reserve the right to exercise our right of sale under Item 9 of our General Terms and Conditions of Business for the recovery of our costs and expenses, in circumstances where for whatever reason, the absent owner fails to pay for any costs incurred and / or remove the offending item from the Yard.
6 : Storage Charges and Payment Terms
6.1: Storage is charged on a quarterly basis, with the quarter consisting of a 13 week (91 days) period, giving Four periods per 52 week year. Payment is required quarterly in advance and prior to boats entering the yard for the first time. Invoices are normally sent out in the week prior to the following dates : First Quarter : 1st January Second Quarter : 1st April Third Quarter : 1st July Fourth Quarter : 1st October
6.2: Storage charges for periods of less than a quarter, are calculated from the daily rate as published in the Annual Yard Tariff.
6.3: Payment terms are from date of invoice, any queries to be raised within 7 days, otherwise payment to be made in full within 14 days, or prior to Launching or leaving the Yard within this period.
