Terms & Conditions of Business

GENERAL YARD ISSUES

Definitions : See General Terms & Conditions of Business

1 : Vehicle Access

1.1: No parking is allowed in the lane approach to the Yard. The lane must
be kept clear at all times to allow access for Emergency Services.

1.2: Parking on the main access loop within the Yard should be done leaving sufficient space
to allow other vehicles to pass comfortably.

1.3: Speed must be limited to a maximum of 5 mph, care must be taken at all times when driving
within the premises.

2 : Electricity Supply

2.1: Electricity Supplies must be taken from the Token Operated Meters.
Tokens can purchased from the Yard Office.

2.2: Hard wiring to the Yard's electricity supply by Owners is strictly forbidden.

2.3: Electrical equipment of any kind when attached to the Yard's Power Supply,
must not exceed 1000 watts power rating.

2.4: Extension Cables must have sound insulation, and be suitably fused and rated
to their application.

2.5: The Yard maintains a record of Owners who have purchased Electricity Tokens.
We reserve the right to disconnect power cables from Meter Sockets where owners
have not purchased the necessary Tokens.

3 : Waste Disposal

3.1: Any household type rubbish, waste /debris from maintenance and improvement work
must be taken and placed in the Waste Bins provided for that purpose, they are
located at the South-end of the Yard.

3.2: Larger Unwanted items, scrap metal, should be reported to the Yard office, who will
advise on disposal options.
Where possible we will arrange disposal free of charge. If disposal costs are unavoidable
these will be passed on to the owner.

3.3: Owners must make their own arrangements for the proper disposal of dead Batteries,
the abandonment of Batteries anywhere on the premises is strictly forbidden.

3.4: Depositing any kind of rubbish/waste/debris in the surrounding hedgerows and land
is strictly forbidden.

4 : Toilet Facilities

4.1: On leaving the Toilets please ensure doors are securely closed. This is vital if we are
to guard against abuse of the Toilet Facility.

4.3: Washing of Antifoul Brushes in the Toilet Block basins and pouring of liquid waste
down Toilets is strictly forbidden.

5 : Health and Safety Considerations

5.1 All persons using any part of our premises and / or facilities for whatever purpose, and whether
by invitation or otherwise do so at their own risk.

5.2: There are few unavoidable hazards within the Yard, parents are asked to keep sight of
young children at all times.

5.3: Owners and visitors should avoid any area of the Yard where boat movements
are in progress.

5.4: Owners or visitors with pets who may be a bit adventurous are advised to tether
or contain the pet during their stay at the Yard.

5.5: Owners using ladders to access their boat during storage, do so at their own risk.
When requiring access to their boat, owners must provide their own ladder. We strongly recommend
that Ladders are adequate for the task, and properly secured to the boat prior to repetitive use.

5.6: In accordance with statutory Health and Safety requirements, Smoking is not permitted
within any Workshop, Office or Toilet Facility situated in Dell Quay Yacht Yard.

6 : Security Considerations

6.1: Where possible remove all valuables, clothing, lifejackets, etc from the vessel.

6.2: Where possible Mark VHF Radios, GPS, Outboards, etc with your Post Code.

6.3: Remove Outboards from Guard Rails.

6.4: An Automatic Security Barrier is located at the main entrance to the Yard.
Operation is by way of a 4 digit security code keyed into the control.
A new code is issued every 3 months and owners will be notified accordingly.
The Barrier is normally open during Yard working hours and closed evenings and weekends.

7 : Arrangements for Owner appointed Contractors

Unlike some Yards we do not impose a charge on valid Contractors working
in Dell Quay Yacht Yard, however, we do require Contractors to conform with
the following basic conditions.

7.1: All Contractors must report to the Yard Office prior to commencement of any work,
and on request, demonstrate that they have been contracted / instructed by an
Owner, and provide proof of adequate third party insurance prior to being
authorised to work in the Yard.

7.2 : Keys will not be issued to Contractors without prior consent of the Owner/Client.

7.3 : Owners who instruct Contractors should ensure they are made aware of the
above conditions.

8 : Change of Owners circumstances

It is essential that Owners notify the Yard Office within 14 days of any change in circumstances,
including, permanent address, contact details, name of vessel, transfer of vessel ownership with details
of new owner.

8.1 Owner's who have their boat up for sale should ensure that any
prospective purchaser is not seeking to purchase with the intention
of taking up permanent residence on the boat whilst it is still in storage
within the Yard premises or attached to a mooring

8.2 Any sale where the new owner takes up permanent residence on
the boat or where we consider it is the owner's intention to do so,
the conditions outlined in the following items will apply :
Appendix 1 Items 10 & 11, Appendix 2 Item 4, Appendix 3 Item 5.

9 : Chichester Harbour Conservancy

9.1 : Owners are expected to conform with Conservancy Regulations at all times,
including the display of a valid Harbour Licence positioned and attached to the
boat in accordance with Conservancy instructions.

9.2 : Owners using Yard Moorings must have valid Third Party Insurance cover in accordance with Conservancy
recommendations.

10 : Custody issues

We accept no obligation of custody for any owner's boat / vessel or any other items in situ within the
the Dell Quay Yard premises, subject to the following circumstances :

10.1.1 : Where owner's are under notice for the removal of their craft from the Yard for whatever reason.

10.1.2 : Non-payment of any Yard service charges after 14 days from date of invoice.

10.1.3 : Any Craft, Trailer, vehicle, or any other item parked or deposited anywhere on the premises
without our formal authorisation or prior knowledge and approval.

10.1.4 : Any unauthorised craft attached to a mooring or removed from a mooring and parked in the
Yard at our discretion.

10.1.5 : Sale of Vessels in Yard custody (See General Terms and Conditions, clause 9)

11 : Slipway, Jetty and Pontoon

11.1.1 : Only owners with Boats registered at the yard for Mooring and / or Storage
purposes are permitted to use these facilities.
Particular care must be taken in wet and / or windy conditions.
Anyone using these facilities, do so at their own risk.

12 : Non-Compliance with Yard Regulations

When incidents of significant or persistent non-compliance are brought to our attention, after taking into account the
circumstances, we reserve the right to serve notice for the removal of a vessel from the Yard or Mooring, terminate
any occupancy onboard, request Contractors or Visitors to leave the Yard. The period of Notice given will be at our
discretion.

from time to time, without notice
